Clayton County Criminal Court Records
A criminal court record is the case-level file kept by the court after a criminal matter is opened. It is not just an arrest entry. In Clayton County, the court file may begin with a Magistrate Court intake event, bond matter, warrant proceeding, or preliminary hearing, and then continue in State Court or Superior Court depending on charge level. The full case record can show filings, docket entries, pleas, motions, orders, disposition, and sentence.
The local court split matters. Superior Court handles felony prosecutions in the Clayton Judicial Circuit. State Court handles misdemeanor and traffic violations prosecuted by the Solicitor General. Magistrate Court criminal matters include arrest warrants, search warrants, bonds on most criminal charges, and preliminary hearings. The charge details themselves are covered more closely in Clayton County arrest records and court charges, while this page focuses on the court case file.
The Magistrate Court Criminal Matters page identifies Magistrate Court as the criminal intake court.
Magistrate entries can explain the early path of a criminal case before the misdemeanor or felony file develops further.
Search Clayton County Criminal Records
Clayton County criminal court records are searched through the county's criminal side of Court Case Inquiry. The Criminal Name Search requires a court selection and last name, with first name or first initial available to narrow the result. The Criminal Case Search requires the court and case-number parts, including year, type, sequence, and optional division.
- Open the county Court Search Options page and choose the criminal search path.
- Use Criminal Name Search if only the defendant name is known.
- Use Criminal Case Search if the case number appears on a notice, subpoena, bond paper, or docket entry.
- Select State Court, Magistrate Court, Superior Court, or All Courts when that option is available.
- Review the docket for charges, hearing events, plea, disposition, sentence, and probation entries.
- Request certified copies through the correct clerk division when a legal copy is needed.
The public portal excludes sealed cases, juvenile cases, adoption matters, protective orders, restricted records, pre-JIS cases, and records outside Clayton County. It also does not replace statewide criminal-history processes. Georgia record restriction and criminal-history access can involve law enforcement, prosecutors, court orders, and the rules in O.C.G.A. Section 35-3-37.
Clayton County Criminal Courts
Criminal court records in Clayton County move through different offices based on case type. Superior Court felony prosecutions are handled by the District Attorney. State Court misdemeanor and traffic prosecutions are handled by the Solicitor General. Magistrate Court is the criminal intake court and is important for warrants, bonds, and preliminary hearings. A record search should follow that split rather than assuming all criminal matters sit in one file room.

The Clayton County District Attorney page documents the felony prosecution office.
Felony criminal court records should be read with the District Attorney role in mind because that office prosecutes Superior Court felony cases.
The District Attorney website is another official source for the felony prosecution office.
Both prosecution sources point to the same local felony case pathway in the Clayton Judicial Circuit.
Clayton County Criminal Case Flow
A criminal case record grows as the case moves through court. Early entries may concern an arrest warrant, search warrant, bond, or preliminary hearing in Magistrate Court. State Court misdemeanor files and Superior Court felony files then record the charge as filed, arraignment, motions, hearings, plea or trial activity, disposition, and sentence. Each step can leave a docket entry even when the full document is not visible online.
Case flow: Charges Filed › Arraignment › Pretrial and Motions › Plea or Trial › Disposition › Sentencing
| Stage | What the Criminal Court Record May Show |
|---|---|
| Charges Filed | The accusation, indictment, complaint, or other charge entry that opens or advances the court case. |
| Arraignment | The proceeding where charges are formally addressed and a plea may be entered. |
| Pretrial and Motions | Requests for court orders, hearing settings, discovery disputes, bond issues, or other case activity. |
| Plea or Trial | A plea, verdict, dismissal, acquittal, or other path toward case resolution. |
| Disposition | The outcome of a charge or case, which may differ by count. |
| Sentencing | Punishment imposed after conviction, including jail, probation, fines, or other conditions when recorded. |
What Clayton Criminal Records Show
A Clayton County criminal court record can combine case identifiers, defendant details, charge history, docket events, and final case outcomes. The court file may show the arrest or warrant path only as it connects to the court case. Jail custody information and booking status are separate from the court record, even when both relate to the same event. For a current custody check, use the inmate record path rather than assuming the criminal docket is current.

Clayton Charges vs Convictions
A charge is an accusation filed into the criminal case. A conviction is a finding or plea of guilt. Clayton County criminal court records can show charges that were amended, reduced, dismissed, nolle prossed, or ended in acquittal. Treating every charge as a conviction misreads the court record. The docket must be followed through disposition and sentencing to understand what happened.
| Point | Charge | Conviction |
|---|---|---|
| Meaning | An allegation filed by a prosecutor or through court intake. | A guilty plea, guilty verdict, or other finding of guilt. |
| Where It Appears | Early in the criminal court record and docket. | Near disposition and sentencing entries. |
| Can Change | May be amended, reduced, dropped, or dismissed. | May lead to sentence, probation, fines, or other conditions. |
| Record Use | Shows what was alleged in court. | Shows the final guilt outcome for that charge. |
Public Clayton Criminal Records
Georgia public access starts with the Georgia Open Records Act, including O.C.G.A. Section 50-18-70 et seq. Court access also depends on court-specific rules, including Uniform Superior Court Rule 21 for public inspection unless access is limited by law or sealing procedure. Clayton County's public criminal search is useful, but certified copies and restricted files still require the clerk or a court order.
Key Rules:
O.C.G.A. Section 50-18-70 et seq. presumes public records are open unless a statute or court order says otherwise.
O.C.G.A. Section 35-3-37 governs many Georgia record restriction issues for qualifying criminal history records.
The Clayton Judicial Circuit Public Defender's Office page is relevant when a person charged with a felony or felony probation matter seeks appointed-counsel screening.
The Public Defender source belongs with criminal case records because defense representation can affect docket events, motions, pleas, and court orders.
Sealed vs Restricted Records
Georgia often uses the term record restriction instead of expungement. A sealed court file is hidden from ordinary public view because of a court order or statute. A restricted criminal-history record may be limited for non-criminal-justice purposes when the prosecutor approves or a court orders restriction under Georgia law. These are not the same thing, and neither should be assumed from an online search result.
| Point | Sealed Court Record | Record Restriction |
|---|---|---|
| Main Effect | Limits public access to the court file or docket. | Limits qualifying criminal-history access for non-criminal-justice purposes. |
| Authority | Court order, statute, or court access rule. | O.C.G.A. Section 35-3-37 process, prosecutor approval, or court order. |
| Who May Still See It | Parties, counsel, court staff, or agencies if allowed. | Criminal justice agencies may retain access in some cases. |
| Clayton Caveat | Sealed cases are excluded from public Court Case Inquiry. | Arresting agency, prosecutor, and court steps may all matter. |
Restricted Clayton Criminal Records
Juvenile criminal matters are not handled as ordinary public adult records. Clayton County's public search excludes Juvenile Court records, sealed cases, adoption matters, protective orders, restricted matters, older pre-JIS cases, and non-Clayton cases. Personal identifying information, medical details, minor information, and other sensitive fields may also be redacted even when the case itself is public.
Drug Court research adds one special local caution: participants must plead guilty to current charges, and the program page says those charges cannot later be expunged from criminal records even if the participant successfully completes Drug Court. That kind of program-specific consequence should be checked in the actual case file and court order before relying on a general search result.
Important: Criminal court records should be verified with the clerk before legal, employment, housing, or licensing use.
Clayton Criminal Record Copies
Superior Court felony records route to the Clerk of Superior and Magistrate Court. State Court misdemeanor records route to the Clerk of State Court. Magistrate criminal intake, bond, warrant, and preliminary-hearing records route through Magistrate Court or the Superior and Magistrate clerk structure. Certified copies require clerk action. A public screen print should not be treated as a certified criminal court record.
