Clayton County Superior Court Overview

Georgia uses Superior Court as the general-jurisdiction trial court. Clayton County is its own Clayton Judicial Circuit, which means Superior Court is not shared with another county circuit in the research map. The court handles felony prosecutions, divorce, title-to-land matters, equity, habeas, mandamus, declaratory judgment, adoptions, and appeals from lower courts. It is the primary trial court for records that are beyond State Court, Magistrate Court, Probate Court, or municipal court authority.

Clayton County Superior Court Judges

Official pages identify five Superior Court judges in Clayton County. Chief Judge Robert L. Mack, Judge Geronda V. Carter, Judge Jewel C. Scott, Judge Shana Rooks Malone, and Judge Aaron B. Mason are listed in the research. Judge Mack is associated with Room 4JC101 and Courtroom 4CR401. Judge Mason is associated with Room 4JC501 and Courtroom 4CR405. Judge Scott is listed with Room 4JC301 and Courtroom 4CR403. Judge Malone is listed with Room 4JC201 and Courtroom 4CR402.

Judge Carter's page includes a notice of livestream of Division 9 proceedings under Uniform Superior Court Rule 9. That detail does not mean every hearing is public online, but it shows that courtroom-specific rules and judge pages may matter when a person is checking calendars, remote access, or hearing instructions.

Clayton County Superior Court Jurisdiction

Superior Court has exclusive constitutional authority over title to land, divorce, equity, declaratory judgment, habeas, mandamus, quo warranto, prohibition, adoptions, felony cases, and appeals from lower courts. Felony criminal cases are prosecuted by the District Attorney. Divorce records are Superior Court records, not Probate Court records. Adoption records are handled under Superior Court authority, but Georgia law seals adoption records and the public portal excludes them.

State Court handles misdemeanors, traffic violations, and civil cases unless Superior Court has exclusive jurisdiction. Magistrate Court handles many smaller and early-stage matters, including civil disputes up to $15,000, dispossessory cases, garnishments, abandoned motor vehicles, county ordinance matters, preliminary hearings, and warrants. Probate Court keeps estate, guardianship, conservatorship, licensing, and marriage records at the South McDonough Street Annex 3 location.

Search Clayton County Superior Court Cases

Superior Court records may be searched through the county Court Case Inquiry when the case is public, entered in JIS, and not excluded. Civil name search allows State Court, Magistrate Court, Superior Court, or All Courts. Civil case-number search requires the court and case number components. Criminal name search also allows All Courts, State Court, Magistrate Court, or Superior Court. Criminal case-number search requires State, Magistrate, or Superior Court and the year, type, sequence, and optional division.

The Court Case Inquiry exclusion language is important on Superior Court searches. Adoption records, Juvenile Court records, Probate Court records, protective orders, sealed cases, restricted cases, pre-JIS cases, and non-Clayton cases do not appear through ordinary public search. Clayton County Superior Criminal Cases

Criminal cases often start before Superior Court. Magistrate Court is the intake court for criminal cases, issues arrest and search warrants, sets bonds on most criminal charges, and conducts preliminary hearings to determine whether there is enough evidence to continue prosecution after arrest. Felony cases then proceed in Superior Court through the District Attorney. Clayton County Superior Court Location

The Harold R. Banke Justice Center is at 9151 Tara Boulevard, Jonesboro, GA 30236. The research describes it as a 727,500 square foot facility, opened on November 6, 2000, with 18 courtrooms, a 1,536 bed detention center, sheriff headquarters, court services, and ancillary offices. It houses the Superior Court, State Court, Magistrate Court, clerks, District Attorney, Solicitor General, Public Defender, and sheriff or court detention functions around the Tara Boulevard campus.

The main court complex is near the 9151 through 9163 Tara Boulevard justice campus. The Probate Court is not in the same building; it operates from Administration Annex 3 at 121 South McDonough Street. Juvenile Court is at the Clayton County Youth Development and Justice Center, 9163 Tara Boulevard.

Federal Court Is Separate

Clayton County is in the Atlanta Division of the U.S. District Court for the Northern District of Georgia. Federal criminal, civil, bankruptcy, habeas, removal, tax, agency, and employment records do not appear in Clayton County Superior Court just because a party lives in the county. Federal records use PACER and the PACER Case Locator.

The Northern District of Georgia website is the federal court source for cases outside Clayton County Superior Court.

The federal court site should be used only when the case is a federal matter, not an ordinary Clayton County Superior Court case.
